Agent terms

Eligibility

• You must hold an active resident or nonresident insurance license with health authority.
• We verify your National Producer Number (NPN) before we turn on your account.
• You must keep your license active. If it lapses or is suspended, tell us at support@rxuracy.com within 5 days.

Permitted use

You may use Rxuracy only to help the named client compare Medicare plans and check whether their medications, doctors and pharmacies are covered.

The records are consumer report information. You may use them only for that purpose.

Prohibited uses

You may not use records, or let anyone else use them:

• for underwriting, eligibility or pricing decisions
• to screen, steer or refuse service to anyone based on their health
• to market to the client
• by reselling, sharing or exporting them, except re-entering them into quoting or enrollment tools for that client's plan review

Getting consent

• The client must be on a live call with you.
• Read the consent script on the screen word for word.
• Never send a code unless the client agrees.
• Never read, enter or ask for the code from anyone but the client.
• Only the person named in the request may authorize it. No one may authorize for someone else, including a spouse or family member, and no one under 18 may authorize.

Medicare marketing rules

You alone are responsible for following CMS marketing rules, scope of appointment requirements, carrier rules and state insurance law. Rxuracy is a lookup tool, not a marketing organization.

Client requests

If a client asks to revoke an authorization, send them to revoke@rxuracy.com. If a client asks for a copy of their authorization, they can use the link in their text while it works; after that, send them to support@rxuracy.com. If a client disputes the accuracy of their records, send them to support@rxuracy.com.

Security

• Keep your password and two-factor device private.
• Do not share your account. Each agent needs their own.
• Lock any device you use to sign in.
• Do not print or save records except as needed for the client's plan review, and destroy copies when you no longer need them.
• Report any suspected unauthorized access to support@rxuracy.com within 24 hours.

Records and audits

Results are deleted within 31 days of the request. Authorization and audit records are kept for 6 years. We may audit your use of Rxuracy, and you agree to cooperate with any audit.

Subscription and billing

• Rxuracy is a monthly subscription per agent, billed in advance through our invoicing provider. It renews each month until you cancel.
• The price is shown on the checkout page and on each invoice. Your monthly lookup allowance is shown on your account page.
• Your lookup allowance resets on the 1st of each month, Central time. Unused lookups do not roll over.
• You may cancel any time by emailing support@rxuracy.com. Cancellation takes effect at the end of the paid month.
• Payments are non-refundable once your account is active. If we cannot verify your NPN, we refund your payment in full.
• We may change the price or the monthly lookup allowance with 30 days' notice by email.

Suspension and termination

We may suspend or close your account for misuse, nonpayment, a license that lapses or is suspended, or while we review a client complaint. You may close your account by canceling.

Indemnity

You agree to defend and repay INSURASAFE LLC for claims, fines, losses and costs, including reasonable legal fees, that come from your misuse of Rxuracy or records, or your breach of this agreement.

Limitation of liability

Records come from a consumer reporting agency and its data suppliers and may be incomplete or out of date. To the extent the law allows, INSURASAFE LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost commissions, profits or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

After this agreement ends

Your duties to keep records confidential and secure, your indemnity, the limitation of liability and our audit rights continue after your account is closed.

Changes

We may change this agreement. We will email you at least 30 days before a material change takes effect, and post the new version here with a new version number. Using Rxuracy after the change means you accept it.
